PETITION TO OPEN THE STATE OF INDIANA

 

attention: governor eric j. holcomb

Whereas,  The Constitution of the United States is the supreme law of the land;

Whereas,  The Constitution of the State of Indiana is the supreme law of the land for matters concerning the State of Indiana;

Whereas,  All public officials take an oath to uphold the United States Constitution and the Constitution of the State of Indiana;

Whereas,  Article 1, Section 2 of the Constitution of the State of Indiana states that, “All people shall be secured in the natural right to worship the ALMIGHTY GOD, according to the dictates of their own consciences;

 

Whereas,  Article 1, Section 26 of the Constitution of the State of Indiana states that “The operation of the laws shall never be suspended, except by the authority of the General Assembly”

Whereas,  Article 1, Section 31 of the Constitution of the State of Indiana states that “No law shall restrain any of the inhabitants of the State from assembling together in a peaceable manner, to consult for their common good; nor from instructing their representatives; nor from applying to the General Assembly for a redress of grievances”

Whereas,  The Governor had constitutional methods at his disposal to handle the Covid-19 crisis;

 

Whereas,  Eric J. Holcomb, Governor of the State of Indiana violated Article 1, Section 2 with his restrictions on worship, prohibiting on his own accord that no in-person worship can be done;

 

Whereas,  Eric J. Holcomb, Governor of the State of Indiana placed uneven restrictions on Hoosiers’ rights to worship, discriminating against those who desire to do so, yet allowing other practices to continue such as the act of abortion;

Whereas,  Eric J. Holcomb, Governor of the State of Indiana, violated Article 1, Section 26 by suspending on his own accord IC 16-19-3-11, IC 16-42-5-28, and IC 7.1-2-3-11 in one Executive Order (EO 20-10), and by suspending on his own accord eight different parts of IC 7.1 in the same Executive Order;

 

Whereas,  Eric J. Holcomb, Governor of the State of Indiana determined on his own accord who was to be considered essential employees or not;

Whereas,  Hundreds of thousands of Hoosiers have either lost their jobs or lost hours because of this pandemic;

Whereas,  The models that the Governor has used to create his unconstitutional power grab are now being shown to be inaccurate; 

 

Whereas,  On March 16th, 2020 Governor Holcomb’s Directive gave the IDHS the authority to order the evacuation of any persons from their residence, dwelling, building, structure, or vehicle and to utilize all property, equipment, and facilities owned, rented, operated as they deem fit;

 

Therefore, I urge you to immediately relent your overreach restrictions on the state of Indiana and lift the shutdown allowing Hoosiers to utilize their Constitutional rights if they so choose.
