Current Indiana law defines feticide as the intentional killing of an unborn child UNLESS that child is a victim of abortion.
According to the current code, if an unborn child is WANTED and murdered, it’s feticide. If an unborn child is UNWANTED and murdered by a hired hitman, it is not feticide.
Instead of protecting the preborn, our law protects the abortionists.
Indiana wants you to believe they banned abortion in 2022, but the truth is, child-killing is legal in our criminal code—and what’s worse, they actually made abortion easier.
Abortion is feticide, and if our Republican majority really is “pro-life,” they should treat it as such and grant ALL unborn children equal protection under the law. During the summer of 2022 they voted into law SB1 while telling us they passed an "abortion ban" the new law states this:
A person who knowingly or intentionally terminates a human pregnancy with an intention other than to produce a live birth or to remove a dead fetus commits feticide, a Level 3 felony.
This section does not apply to:
(1) the pregnant mother whose pregnancy is terminated;
(2) a person who in good faith provides medical treatment to a pregnant woman that results in the accidental or unintentional termination of the pregnancy; or
(3) a physician licensed under IC 25-22.5 who, upon the request of a pregnant woman, performs a medical procedure to terminate her pregnancy, even if the procedure is not authorized under IC 16-34-2-1.
This is NOT even close to banning abortion. We must stop allowing babies to be murdered in our state!
